(1.) The present petition, under section 378 (4) of the Code of Criminal Procedure, has been filed against the judgment dated 24.3.2012, passed by the Ld. Additional Sessions Judge, Narnaul, whereby Leela Dhar, respondent No. 1 was acquitted of the charges in FIR No. 192 dated 12.10.2004 filed under sections 279/337/304-A IPC by giving him the benefit of doubt by reversing the findings recorded by the Ld. Trial Court in order dated 11.8.2011.
(2.) The prosecution case in brief is that on 12.10.2004, a message was received at Police Post Faijabad from Police Station, Sadar Narnaul in respect of one Satyavir in a motor vehicular accident. Constable Vidya Nand went to Govt. Hospital, Narnaul, where Bhoop Singh was present near the dead body of Satbir. He made a statement that he along with deceased Satyavir were going for their duty in Mini Bank, Nuniwala and when they crossed the Police Post Faijabad, a motorcyclist driving the vehicle in a rash and negligent manner, hit against Satyavir. He fell down and received multiple injuries. Satyavir was taken to hospital, where he was declared brought dead. On the statement of Bhoop Singh, FIR No. 192 dated 12.10.2004 was registered against the appellant under sections 279/337/304-A IPC.
(3.) After the trial, appellant Leela Dhar was convicted and sentenced under sections 279/337/304-A IPC by the ld. Trial Court on 11.8.2001.
