After hearing the learned counsel for the applicant and going through the record of the case, this Court is satisfied that the delay has been sufficiently explained and the same deserves to be condoned. In view of the above, the delay of 41 days is condoned and the application under Section 5 of the Limitation Act stands allowed.

(3.) The instant application under Section 378 (4) of the Code of Criminal Procedure ('Cr.P.C.' for short), has been filed by the applicant, seeking leave to file appeal against the judgment of acquittal dated 19.8.2011.
