JUDGEMENT

(1.) The present application for suspension of sentence was received through the Superintendent, Model Jail, Chandigarh, by post and notice of the application was issued to the respondent State vide order dated 30.8.2012.

(2.) The applicant-appellant, Om Parkash, son of Raghu Nandan, resident of Juggi No. 167, Rajiv Shahpur Colony, Sector 38 (West), Chandigarh, presently confined in the Model Jail, Chandigarh, was held guilty for the offence punishable under Section 304, Part-II, IPC, and sentenced to undergo rigorous imprisonment for seven years besides payment of fine of Rs. 5,000/- and in default to undergo further rigorous imprisonment for two months, in FIR No. 292, dated 10.7.2009, registered at Police Station, Sector 39, Chandigarh.

(3.) Perusal of the paper book reveals that the applicantappellant, Om Parkash, has already suffered incarceration for three years and approximately two months.
