JUDGEMENT

(1.) JUDGMENT debtor (JD) Devinder Singh has filed this execution second appeal having failed in both the courts below.

(2.) SUIT filed by respondent � decree holder (DH) Suresh Kumar against appellant JD was decreed for recovery of money. Land of JD was also attached before judgment under Order 38 Rule 5 of the Code of Civil Procedure (in short, CPC). In execution proceedings, the attached land was sold by public auction on 21.7.1992 in favour of highest bidder Tarsem Chand Garg.

(3.) LEARNED executing court i.e. learned Civil Judge (Junior Division), Samana vide detailed order dated 30.1.2001 dismissed the objections filed by the JD. Appeal against said order preferred by JD has also been dismissed by learned Additional District Judge, Patiala vide detailed judgment dated 19.1.2010. Feeling aggrieved, JD has filed this execution second appeal.
