JUDGEMENT

(1.) In the present case, the appellant was convicted and sentenced by the trial Court for offence under Section 15 of the Narcotic Drugs & Psychotropic Substances Act, 1985 (hereinafter referred to as the "Act") and ordered to suffer imprisonment for 10 years rigorous imprisonment and to pay a fine of Rs. 1,00,000/- and in default to further undergo RI for a period of two years, qua commission of offence punishable under Section 15(C) of N.D.P.S. Act.

(3.) In compliance of the aforesaid order, learned State counsel has placed on record affidavit dated 13.10.2012 of Guriqbal Singh, Inspector, SHO Police Station City Samana in which he has stated that appellant-Kishan Singh has expired on 26.12.2009.
