JUDGEMENT

(1.) PETITIONERS contend that as they are working on the technical posts they, in pursuance of the instructions dated 09.08.2010, have been granted the technical pay scale of Rs. 1200- 2040 w.e.f. 01.05.1990 and the consequential pay revision but arrears have not been paid to the petitioners.

(2.) THIS Court in CWP No. 17808 of 2011 titled as Ishwar Singh and others vs. State of Haryana and others, allowed writ petitions on 13.02.2012 granting the petitioners therein benefit of arrears. Petitioners, who are similarly placed, put forth their claim for grant of arrears in the light of the judgment passed by this Court in Ishwar Singh and others (supra) through a legal notice dated 09.04.2012 (Annexure P-5) but without any response from the respondents.

WITHOUT going into the merits of the case or commenting thereon, the present writ petition is disposed of with directions to The Executive Engineer, Public Health Engineering Department, Ambala Division, Ambala Cantt.-respondent No. 4 and The Executive Engineer, Public Health Engineering Department, Division Naraingarh, District Ambala-respondent No. 5 to consider and decide the legal notice dated 09.04.2012 (Annexure P-5) within a period of three months from the date of receipt of certified copy of this order. The decision so taken be conveyed to the petitioners forthwith. In case, the petitioners are held entitled to the claim made by them through their legal notice, the consequential benefits, if any, be released to them, in accordance with law, within a further period of two months.
