KARAM SINGH Vs. STATE OF HARYANA

JUDGEMENT

(1.) Petitioner Karam Singh son of Ujjal Singh has preferred the instant petition, for the grant of regular bail in a cross case registered against him alongwith his other coaccused, vide FIR No.81 dated 11.5.2012, for commission of offence punishable under Sections 148, 302, 307, 323, 324 325 and 341 IPC, by the police of Police Station, Ladwa, District Kurukshetra, invoking the provisions of Section 439 Cr.P.C.

(2.) Concisely the prosecution claimed that complainant Rachna Ram son of Partap Singh was the co-owner and in possession of the land in question. On 9.5.2012, petitioner Karam Singh collected other co-accused, formed an unlawful assembly armed with deadly weapons, attacked and caused injuries to the complainant party with their respective deadly weapons culminating into death of Baldev Singh (deceased). In the background of these allegations and in the wake of statement of complainant Rachna Ram, the present case was registered against the petitioner and other co-accused in the manner indicated here-in-above.

(3.) Notice of the petition was issued to the State.
