(1.) quashing of FIR No. 113 dated 24.7.2010 under Sections 406/420 IPC registered at Police Station Sadar, District Hoshiarpur (Annexure P-1) is sought on the basis of compromise (Annexure P-2).
(2.) The FIR was lodged on the statement made by the complainant-Malkiat Chand. The complainant on account of sending his son-Harvinder Kumar abroad paid Rs. 6 lacs to the petitioners who are travel agents. The petitioners are related to him. He gave his passport. The complainant paid Rs. 2 lacs for sending his son to South Korea. This money was paid in the year 2006 and neither his son was sent abroad nor the money was returned back. In this background, the aforesaid FIR was registered.

Subsequently, with the intervention of the respectables the matter was settled and the complainant has no grudge against the petitioners now and is not interested in continuing the criminal proceedings initiated against the accused. Compromise is Annexure P2. Affidavit of the petitioner-Avtar Kaur is Annexure P3. On notice, counsel for respondent No.2 has put in appearance and has tendered the affidavit of Malkiat Chand, who is present in Court. As per this affidavit, the matter has been settled with the intervention of the parents and other respected persons. There is no grievance between the parties and they have decided to live in peace and harmony. Complainant has no objection if the FIR in this case is quashed as no useful purpose would be served by continuing the proceedings.
