JUDGEMENT

(1.) CHALLENGE in the present appeal is to an order passed on 6.12.2012 passed by the learned Single Judge of this Court, whereby the writ petition filed by the appellant challenging the order dated 10.9.2012 remained unsuccessful.

(2.) VIDE the aforesaid order, the Deputy Registrar exercising the powers of the Registrar has approved the list of 62 members as eligible for allotment of flats of the Society. The grievance of the appellant is that the Society has finalized the list in contravention of the guidelines dated 22.10.2008 (Annexure P-5) inasmuch as the allotment is required to be made strictly on seniority as per the membership register and only those members are eligible who have paid the required amount called by the Society.

(3.) ADMITTEDLY , the said order is subject matter of challenge in appeal at the instance of the Society which is pending decision. It may be noticed that the appellant has the remedy of revision against the order granting approval to the list of members on 10.9.2012. However, at the insistence of learned counsel for the appellant, we have gone through the merits of the arguments raised as well.
