Petitioner Vidya Devi Tiwari wife of Mata Parsad Tiwari has directed the instant petition for the grant of anticipatory bail in a case registered against her along with her other co-accused, by virtue of FIR No.39 dated 12.6.2012 (Annexure P1-A), on accusation of having committed the offences punishable under sections 406, 420 and 120-B IPC by the police of Police Station Naya Gaon, Distt. S.A.S.Nagar, Mohali, invoking the provisions of section 438 Cr.PC.
(2.) Concisely, the prosecution claimed that the petitioner was the owner of the plot in dispute. She had already sold it on 2.2.2012, for a total sum of '1,85,000/- to Karnail Singh son of Heera Singh, vide registered sale deed. Karnail Singh, vendee has further sold the plot on 16.3.2012 to Anzar Khan, by way of registered sale deed. Although the petitioner had already sold the plot in question to Karnail Singh, but still, she illegally entered into an agreement to sell on 21.1.2011 with complainant Bhagat Singh Gulia of the same plot for a total sale consideration of '7,50,000/-. She received the entire amount and issued the receipt to him (complainant) in this respect.

Leveling a variety of allegations and narrating the sequence of events, in all, according to the complainant that the petitioner has cheated him and illegally misappropriated the amount of '7,50,000/-. In the background of these allegations and in the wake of complaint of the complainant, the present case was registered against the petitioner in the manner depicted here-in-above.
