(1.) The present application has been preferred by the applicant wife under Section 24 of the Code of Civil Procedure, praying for the transfer of the petition titled as 'Manjit Singh Vs. Reena Rani', filed by the respondent under Section 13 of the Hindu Marriage Act, 1955 (for short 'the Act'), from the Court of learned Additional District Judge, Ambala, to the Court of competent jurisdiction at Rajpura.
(2.) Learned counsel for the applicant contends that the applicant filed a petition under Section 125 Cr. P. C. , which was withdrawn on account of the compromise effected between the parties before the Lok Adalat on 16.09.2006. However, the respondent did not honour the compromise. Rather, she was mercilessly beaten on 20.4.2007 and turned her out of her matrimonial house. The applicant had to again file petition under Section 125 Cr. P. C. On 14.5.2007 which is pending adjudication before the Court of competent jurisdiction at Rajpura, District Patiala, which is prior in time. Learned counsel for the applicant further contends that the applicant is a resident of District Patiala, and the purpose of filing the petition under Section 13 of the Act is only to harass the applicant.
(3.) The learned counsel for the respondent has vehemently opposed the prayer.
