JUDGEMENT

(1.) The appellant has filed the present appeal against the judgment and order dated 6.12.2011 and 7.12.2011 passed by the Special Judge, Jalandhar, whereby he has been convicted under Section 21(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short "the NDPS Act") in FIR No.163 dated 6.8.2010 registered at Police Station Div. No.7, Jalandhar and sentenced to undergo rigorous imprisonment for a period of one year and to pay a fine of Rs.5,000/- and in default of payment of fine, to further undergo rigorous imprisonment for one month.

(2.) According to the case of the prosecution, the appellant was apprehended on 6.8.2010. Upon the search of the accusedappellant, 84 grams of smack/heroin was recovered from his right pocket.
