(1.) Appellant has preferred this appeal challenging his conviction and sentence under Section 376(2)(g) of the Indian Penal Code ('IPC' for short) as ordered by the trial court vide judgment/order dated 22.4.2008/24.4.2008.
(2.) On 19.6.2006, Inspector Wazir Singh along with other police officials were on patrol duty. When they were going towards village Kitlana at about 1.00 A.M., they found one motor cycle without number parked on the left side of the road. They stopped their vehicle with a view to check the motor cycle. They saw three boys running away at a distance of about 15 feet from the nearby bushes. One of the said person was apprehended and on inquiry, he disclosed his name as Binder Singh. One insane lady was seen lying near the bushes. Her salwar was lying by her side. The lady was made to wear her salwar. The names of the boys, who had run away, were disclosed by the appellant as Guggar and Shilu Rajput. The appellant admitted that he had committed rape of the insane lady. The motor cycle lying at the spot was taken in possession.
(3.) On the basis of the ruqa sent by Inspector Wazir Singh, formal FIR No. 202 dated 19.5.2006 was registered at Police Station Sadar Bhiwani under Section 376 IPC.
