JUDGEMENT

(1.) Prayer in this petition is for grant of anticipatory bail to petitioner Bir Singh, in a case arising out of FIR No.145, dated 10.09.2012, under Sections 307 and 427 read with Section 34 of the Indian Penal Code registered at Police Station City South, Moga, District Moga.

(2.) Acording to the allegations , the petitioner along with his co-accused had gone to the house of the complainant in the mid-night and threw a pillar weighing about 50 kilogram from the roof with an intention to kill the complainant who was sleeping there on a cot. The presence of the petitioner and his co-accused was recorded in the CCTV fixed at the house of the complainant.

(3.) Learned counsel contends that the petitioner does not figure in the CCTV footing. He further contends that the petitioner had no enmity with the complainant side. He further contends that Beant Singh alias Kaangi has already been arrested.
