JAGROOP SINGH Vs. STATE OF PUNJAB

JUDGEMENT

(1.) This appeal has been filed by appellant-Jagroop Singh, who is aggrieved against the judgment and order dated 31.7.2007 passed by the learned Sessions Judge, Fatehgarh Sahib whereby the appellant has been held guilty for the commission of offence punishable under Section 302 of the Indian Penal Code ('IPC' - for short) and sentenced to undergo imprisonment for life and to pay a fine of '10,000/- and in default of payment of fine to further undergo rigorous imprisonment for a period of six months.

The case of the prosecution in brief is that the FIR was registered on the statement of Sucha Singh, who has stated that on 4.8.2005, complainant-Sucha Singh and his brother Sakinder Singh came to Sirhind Bazar in connection with some domestic work. Darbara Singh had not gone to his village for the one week earlier. Due to this reason complainant and his brother had gone to G.O. Mess for enquiry but he was found on duty.

(3.) They had a talk with Darbara Singh and he replied that for the many days Jagroop Singh had gone to his house but did not return. Due to this reason, he could not visit his house. Complainant suggested Darbara Singh to get himself transferred, if Jagroop Singh is not performing his duties properly. Darbara Singh replied that In-charge had written a letter against Jagroop Singh. After few days, some other employee would be deputed.
