SUBHASH CHANDER AND ANOTHER Vs. STATE OF PUNJAB

JUDGEMENT

(1.) By way of this petition filed under Section 482 of the Code of Criminal Procedure, 1973, the petitioners have sought quashing of FIR No. 109 dated 10.4.2001 (Annexure P-1), under Sections 323/ 324/ 148/ 149 of the Indian Penal Code, 1860 ('IPC' for short), registered at Police Station Division No.5 Ludhiana and subsequent proceedings arising therefrom in view of the compromise arrived at between the parties.

(2.) Vide order dated 14.12.2011, the parties were directed to appear before the trial Court and the trial Court was directed to record the statements of the parties and submit its report qua the compromise effected between them.

(3.) In pursuance to the said order, the trial Court, after recording of the statements of the parties, has reported that the compromise has been effected between the parties voluntarily. Respondent No.2 is present in person along with his counsel and has stated that he has no objection if the FIR in question is ordered to be quashed.
