JUDGEMENT

(1.) Surinder Kamboj, the petitioner has sought pre-arrest bail in a case registered by way of FIR No. 53 dated 05.04.2012 at Police Station Ferozepur Cantt, District Ferozepur, for an offence punishable under section 420 IPC.

(2.) Learned counsel for the petitioner has submitted that Sucha Singh, complainant has remained a sarpanch of the village. According to him, he is quite an intelligent person, who has alleged in the FIR that the petitioner asked him to pay a sum of Rs. 2,50,000/- to him for waiver of his loan of Rs. 30,00,000/-. It is the allegation that the petitioner claimed that he is Chairman of Land Mortgage Bank(for short 'the Bank') and he can exercise his powers in this regard. Sucha Singh is said to have paid this amount but despite that the loan was not waived and the amount was also not returned.

Learned counsel for the petitioner has further submitted that a similar complaint was made earlier by the complainant, on which inquiry was conducted by Superintendent of Police (City), Ferozepur. He referred me in this regard to Annexure P/1, the report submitted by Superintendent of Police (City), Ferozepur to Senior Superintendent of Police, Ferozepur on the complaint of Sucha Singh. According to him, the Superintendent of Police found no truth in the allegations of Sucha Singh and recommended his application to be filed. The said report of Superintendent of Police (City), Ferozepur was approved by Senior Superintendent of Police, Ferozepur also. According to him, this false complaint has been filed by the complainant on the same allegations against the petitioner. He has further submitted that the petitioner has joined the investigation.
