JUDGEMENT

(1.) Criminal Appeal No. 933-SB of 2000 has been preferred by Sat Pal, whereas Criminal Appeal No. 1070-SB of 2000 has been instituted by Guru Dutt. Both these appeals are directed against the judgment dated 16.9.2000 rendered by the Court of Additional Sessions Judge, Panipat, who found the appellants guilty of offence under Sections 120-B, 364, 347 and 507 IPC and vide a separate order dated 18.9.2000 sentenced them as under:- <FRM>JUDGEMENT_776_LAWS(P&H)1_2012(1).html</FRM>

(2.) All the sentences were ordered to run concurrently.

(3.) Criminal proceedings were set into motion on the basis of FIR Ex.PF lodged at the instance of Dharam Singh PW.4, who appeared at the Police Station Samalkha and made a statement to PW.10 Sub Inspector Rameshwar Dass, Station House Officer on 29.8.1992 at about 6.30 P.M. In his statement, Dharam Singh stated that he was a resident of village Budina kalan. He was an agriculturist and was also engaged in the work of Transport. He was having his residential house at Samalkha Town also. He was a father of three sons. On 25.8.1992 at about 3.00 P.M., his son Jagdeep, aged about seven years, who was a student of 2 nd standard, went out from the house to play with the children but by the evening time had not returned home. For the whole day, the family searched for him but no clue was found. His search was carried amongst the relations also but it bore no fruit. One of the villagers informed the complainant that at about 5.00 P.M., a Maruti Car was standing at a distance of about 1 Km. from Bus Stand Biholi towards Samalkha wherein 4/5 young boys were sitting and one young boy had brought Jagdeep, son of the complainant, on a motorcycle from the village and handed him over to the young boys sitting in the said Maruti car, which went towards Samalkha. On 29.8.1992 at about 3.00 P.M., when the complainant reached his home at Samalkha, he found an envelope near the door inside his house upon which his address was written in English. On opening of the envelope, one paper written in Hindi was found therein, in which it was written that he should arrange a sum of Rs. 6,00,000 for release of his son and in case any cleverness is shown, he would be responsible for the death of his son. The complainant produced the envelope before the police and stated that he was confident that his son has been kidnapped by those persons, who were sitting in Maruti Car, for ransom. The investigation of the above said FIR was carried. The envelope and letter Ex.PD and Ex.PE, respectively, were taken into possession by the police vide recovery memo Ex.PG.
