JUDGEMENT

(1.) The facts of the case in short compass, are that the marriage of the petitioner-husband, Surender, was solemnized with respondent No.1-wife, Smt. Sulochna, on 04.05.2001 at village Kaliravan, Tehsil and District Hisar, as per Hindu rites and customs. Gaurav and Sameer respondents No. 2 and 3, respectively, were born out of the said wed lock. The family members of respondents No. 1 had performed the marriage with great pump and show. A huge amount of dowry was given to the petitioner-husband and his family, however, the petitioner was not satisfied with the articles given in the marriage and he started demanding a motor-cycle and Rs. 21,000/- in cash from respondent No.1.

On 17.07.2011, the mother and brother (Rajender Soni) of respondent No.1 went to her matrimonial home just to request the petitioner not to maltreat and humiliate her (respondent No.1) on account of bringing of inadequate and insufficient dowry but instead of acceding to their request, the petitioner thrown the respondent No.1 along with two minor sons, i.e. respondents No. 2 and 3, saying that they (the respondents) had no place to live with him unless and until a motor cycle and cash amount of Rs. 50,000/- were given to him. The petitioner also threatened respondent No.1 by saying that if she would dare to come to his house then he would kill her and, thereafter, respondent No.1 along with her minor sons started residing at the house of her parents.

(3.) It was further alleged that the petitioner was suffering from all vices and used to come late in the night after consuming liquor and always used to maltreat and beat respondent No.1. The respondent-wife also alleged that the petitioner was an employee of Government Livestock Farm, Sirsa Road, Hisar, and drawing a salary of Rs. 15,000/- per month. It was also averred that she had no means to maintain herself and two minor sons. She claimed Rs. 5000/- per month as maintenance for herself and Rs. 2000/- each for her minor sons.
