(2.) We have heard the submissions made by Mr. Vikram Chaudhri, learned counsel for the applicant, Mr. S.S. Dhaliwal, Addl. Advocate General Punjab appearing for the State and Mr. Vishal Rattan Lamba, Advocate, for the two accused, namely, Vipan Sharma and Rajinder Singh alias Bittu Sharma.

(3.) Without standing on technicalities and considering the period of delay in preferring the application seeking special leave to file the appeal, we propose to allow the application so that the main application seeking leave to file an appeal could be decided on merits. Therefore, the application is allowed.
