JUDGEMENT

(1.) At this stage, Mr. Harkesh Manuja, Advocate has put in appearance for respondents no. 3, 6 and 7.

(2.) The present appeal has been filed by the plaintiff-appellant, who is aggrieved against the dismissal of his suit for declaration and relief of permanent injunction.

(3.) The case of the plaintiff-appellant was that he is Kumhar (potter) by caste and a non-proprietor and was residing with his family in the village Khanda since the time of his grand father. The ancestors of the plaintiff were settled by the villagers of village Khanda by the ancestors of Panna Kirnan of village Khanda and they gave the land marked by letters A.B.C.D. depicted in the site plan for residential purposes with dimensions AB-180', CD-180' and BD-60' total measuring 1500 square yards. It is further the contention of the plaintiff-appellant that the ancestors of the defendants and their successors would not dispossess the ancestors and their successors in interest of the plaintiff.
