JUDGEMENT

(1.) Mohinder Singh, the petitioner seeks pre-arrest bail in a case registered by way of FIR No. 117 dated 11.06.2010 at Police Station Sidhwan Bet, District Ludhiana, for an offence punishable under sections 406, 420 and 506 read with section 34 IPC.

Briefly stating, the case of the prosecution is that Gurmail Singh, an agriculturist of village Ghamnewala, Tehsil Jagraon, District Ludhiana, has been cheated by the petitioner and others in a huge sum on the promise of taking him abroad after his marriage with Ranjit Kaur. The deal was settled at Rs.30,00,000/- and it was agreed that besides this amount, Gurmail Singh would spend on his marriage with Ranjit Kaur. In the marriage, a sum of Rs.25,00,000/- was paid to Mohinder Singh, petitioner. Apart from the same, ornaments weighing 20 tolas gold were given to Ranjit Kaur and a sum of Rs.3,00,000/- was spent in the celebration of the marriage. Thereafter, visa was applied which was rejected by the Canadian Embassy on the ground that the papers of divorce of Ranjit Kaur from her previous husband were fictitious.

Learned counsel for the petitioner has submitted that compromise was arrived at between the parties where it was agreed that the petitioner would pay a sum of Rs.25,00,000/- to Gurmail Singh, complainant. According to him, a sum of Rs.15,00,000/- was paid to the complainant on receipt of which he gave the affidavit and a sum of Rs.10,00,000/- has been deposited with the Registry of this court.
