BIR SINGH AND ANOTHER Vs. STATE OF HARYANA

JUDGEMENT

(1.) The petitioners, by way of instant petition under Section 439 Cr. P. C. , seek bail pending trial in the case arising out of FIR No. 370 dated 21.6.2012 under Sections 406, 420, 447, 448, 467, 468, 120-B IPC, registered at Police Station City Jind, District Jind. Notice of motion was issued.

(2.) Learned counsel for the petitioners submits that suit for specific performance filed by the complainant-Ravinder Singh, vide Annexure P-1, is pending decision before the learned court of competent jurisdiction. He further submits that petitioners are old aged persons, petitioner No. 1-Bir Singh being 70 years old and petitioner No. 2-Sultan Singh being about 61 years, and they are inside the jail since 3.7.2012.

(3.) Learned counsel for the petitioners concluded by submitting that no useful purpose would be served by keeping the petitioners inside the jail because the trial is likely to take considerable long time.
