(1.) Petitioners have preferred this petition under Section 482 of the Code of Criminal Procedure, 1973 for quashing of criminal complaint No.367-1 dated 25.10.2007 (Annexure P-4) titled as 'Gopi chand vs. Ashok Hooda etc.'; summoning order dated 31.7.2008 (Annexure P-7) under Sections 363, 365, 371, 372, 511 and 120-B of the Indian Penal Code, 1860 (IPC for short) and all the subsequent proceedings arising therefrom.
(2.) Case of the complainant, in brief, is that he was married to Suresh Devi about 22-23 years ago. Out of the said wedlock, three children were born. All the accused-petitioners had hatched a conspiracy to finish the complainant. They represented to the complainant that they would get him appointed as a security guard in telephone exchange and they got him appointed as such.
(3.) Thereafter, the petitioners carried on illegal/ immoral activities in the house of the complainant in his absence. Petitioners had called the wife of complainant along with his children at village Charkhi on the eve of birthday of petitioner No.3 Babli. When the complainant reached there, his wife and children were not allowed by the petitioners to return back with him. Due to fear, complainant went to Chattisgarh. Wife and children of the complainant were residing at Bhiwani. Petitioners were indulging in prostitution. When the complainant objected to it, he was inflicted injuries by the petitioners.
