JUDGEMENT

(1.) FOR reasons mentioned in the application, which is accompanied by affidavit, delay of two days in re-filing the appeal is condoned.

(2.) MAIN Appeal : Plaintiffs Vijay Kumar etc., having been non-suited by both the courts below, have approached this Court by way of instant second appeal.

(3.) CHAMAN Lal was common ancestor of the parties. He had three sons namely Bisham Lal � since deceased (father of plaintiffs no.1 and 2), Harish Chander � defendant no.5 (father of plaintiffs no.3 and 4) and Laxman Dass � defendant no.1 since deceased and represented by his legal representatives.
