(1.) This judgment shall dispose of Criminal Appeal No.D-333- DB of 2009 filed by appellant-Satish Kumar and Criminal Appeal No.D-263-DB of 2010 filed by appellant Vipin as these arise out of the same judgment dated 04.02.2009 and order dated 05.02.2009 passed by the learned Addl. Sessions Judge, Karnal whereby both the appellants were convicted and sentenced to undergo rigorous imprisonment for life and to pay a fine of Rs.10,000/- each and in default of payment of fine to further undergo rigorous imprisonment for a period of two years each under Section 302 IPC. They were also convicted and sentenced to undergo rigorous imprisonment for a period of six months each under Section 323 IPC and rigorous imprisonment for a period of two years and to pay a fine of Rs.3,000/- each and in default of payment of fine to further undergo rigorous imprisonment for a period of six months each under Section 325 IPC. However, all the sentences awarded to the appellants-accused were ordered to run concurrently.
(2.) Prosecution story in brief is that FIR was registered by ASI Japan Giri on the basis of statement of Rameshwari, recorded at 6:15 p.m. on 30.08.2006.
(3.) As per prosecution version, Rameshwari is the real sister of Randhir Singh, injured. Randhir Singh has four sons and one daughter from his earlier wife Sushila, namely Satish @ Kala (unmarried), Vipin @ Pipan (married), Devinder @ Munna (married), younger daughter Meenu age 14 years studying in 8 th class and youngest son Sunil Kumar aged 12 years studying in 8 th Class.
