JUDGEMENT

(1.) By filing this revision petition under Article 227 of the Constitution of India, defendant No. 2 Alka Goyal has assailed order dated 30.03.2012 (Annexure P-1), passed by the trial court, thereby dismissing application moved by petitioner for secondary evidence of site plan.

(2.) Defendant No. 2-petitioner alleged in her application that there was site plan prepared by Municipal Council, Bhiwani and approved by State Government regarding the scheme in which the disputed plots are located but the said original site plan has been lost and, therefore, petitioner be allowed to lead secondary evidence thereof.

(3.) The plaintiff resisted the application by pleading that there was no such site plan sanctioned by State Government and rather the Municipality had prepared the site plan at its own level and plaintiff has already produced certified copy thereof as Ex. P-7.
