POOJA AND ANOTHER Vs. STATE OF PUNJAB

JUDGEMENT

(1.) This order shall dispose of Crl. Misc. No. M-18612 of 2012 titled 'Pooja and another vs. State of Punjab', Crl. Misc. No. M-19163 of 2012 titled 'Rajni vs. State of Punjab and Crl. Misc. No. M-21615 of 2012 titled 'Sarabjit Kaur vs. State of Punjab', as they arise out of the same FIR.

(2.) These petitions have been filed under Section 439 of the Code of Criminal Procedure for grant of concession of regular bail to the petitioners in case FIR No.97 dated 2.6.2012 under Sections 4, 5, 6, 7, 8 of the Immoral Traffic (Prevention) Act, 1956 read with Section 120-B IPC, registered at Police Station Sadar, Patiala.

(3.) Brief facts of the case are that ASP-cum-Incharge, PS Sadar Patiala, accompanied by other police officials (male and female) were in a Government gypsy. When they reached near the Professor Colony opposite Punjabi University, Patiala, for the purpose of round and investigation of bad elements, then an informer gave an information that Kamaljit Kaur @ Kamal wife of Tejinder Singh, resident of Khudda, PS Sanaur, Ranjit @ Jeeta son of Phoola Singh Jatt, resident of Khudda, PS Sanaur, Karamjit Kaur wife of Harman, resident of Sehna Barnala, Sandeep Singh @ Goldy son of Shiv Charn Singh, resident of Gharacho, PS Bhawanigarh, District Sanaur, run a brothel in a kothi at Phase-3, Professor Colony by conniving with each other and supply girls to the customers after taking money and distribute the income between each other, which is earned from the unlawful occupation, and give some share to the girls. It is also mentioned in the FIR that on that day also the deal of girls and customers was going on in the said kothi. On treating the information as reliable and trustworthy, raid was conducted. Five cars were standing before the said kothi. The raid was conducted by Sh. Dhruman Nimbale, IPS/ASP, posted as SHO, P.S. Sadar, Patiala, at the relevant time, and he sent H.C. Darbara Singh as decoy witness. He paid Rs. 1,000/- to the incharge of brothel Kamaljit Kaur and in return he was forwarded to one girl named Rani. Immediately thereafter, brothel was raided by the police party. 11 girls, who were being used as prostitutes and three customers were apprehended at the spot. In that raid petitioners have also been arrested and sent in jail.
