JUDGEMENT

(1.) A young girl at the threshold of her formative life seeks to retrieve herself of the effect of her mistake, which, as per her has happened in all innocence. This mistake apparently is rather harsh for her career. For this, she has to take entire blame herself alone. Though meritorious and, thus, could have got admission in the Medical/Dental Stream for becoming a doctor, but has not been able to achieve that due to small but a significant mistake. She was late in making her application for admission. Earnest efforts were made to find if she can be helped but except for sympathy nothing can be offered to her. It may not be any solace for her but nothing else is possible with legal position against her. Any further misplaced sympathetic consideration may take away the chance of someone, who was vigilant enough to apply properly and in time. The court, thus, cannot hear the plea in mercy pressed so very hard by her counsel.

(2.) The petitioner is a daughter of serving Indian Army Officer and was successful in CET-2012 examination conducted by the Panjab University, Chandigarh. She secured 206 rank and was applicant for admission to Government Medical College & Hospital, Sector 32, Chandigarh. The process of making application was conducted online. The petitioner blames that due to lack of clarity and absence of complete information, she failed to submit her form in time before the last date which was 26.6.2012. As per the petitioner, this was due to complete ambiguity on the website of respondent No.1-University, because of which, she was prevented from submitting her form in time. Petitioner would partly attribute this to the absence of her parents, who were not available for any help at the crucial time when she alone had to arrange submission of applications. She has accordingly approached this court to pray for indulgence once the respondents refused to entertain her claim.

(3.) The claim of the petitioner that she is a meritorious student may be genuine as she obtained 94% marks in Secondary Education Examination. She secured 91.2% marks in 10+2 as well. Being desirous of perusing a career in medical stream, she applied for CET-2012 conducted by respondent-University. The prospectuscum- application form provided that common entrance test for various courses, including B.A., LLB, M.B.B.S., B.D.S., B.A.M.S., P-Pharma, B.Sc.(Honours) would be held on 27.5.2012. The result of CET examination was declared and the petitioner secured 206 rank as already noted.
