JUDGEMENT

(1.) The defendant has come forward with the present revision praying to revise the order of dismissal passed by the trial Court in the application moved by the defendant under Order 6 Rule 17 CPC.

(2.) The suit was filed for mandatory injunction as well as permanent injunction by the plaintiff as against the defendant.

(3.) By way of amendment to the original pleadings found in the written statement, the defendant has sought to introduce the stand taken by it in its complaint registered as FIR No. 748 of 2006 under Section 408, 420 and 120-B IPC as well as the alleged contradictory stand set up by the plaintiff in the complaint given by him.
