JUDGEMENT

(1.) Appellant has preferred this appeal challenging his conviction and sentence for commission of an offence under Section 302 of the Indian Penal Code ('IPC' for short) as ordered by the trial court vide impugned judgment/order dated 07.11.2007.

(2.) The facts of the present case are peculiar. Surjit Kaur, mother of the appellant had died during the night intervening 24.5.2006/25.5.2006. The appellant got recorded Daily Diary Report ('DDR' for short) No. 24 dated 25.5.2006 at Police Station Vijay Nagar. The said DDR was recorded at 4.40 P.M. The complainant stated that he was resident of house No. 74, street No. 1, Guru Gobind Singh Nagar, Amritsar and was running a general store shop in the said house. They were two brothers.

(3.) His elder brother Dharminder Singh was presently residing in Canada with his family. His father had died about two years ago.
