(1.) Petitioner had faced trial qua commission of offence punishable under Sections 279, 337, 338 of the Indian Penal Code, 1860 (IPC for short).
(2.) The trial Court vide judgment/ order dated 2.6.2010 convicted and sentenced the petitioner qua commission of offence punishable under Sections 279, 337, 338 IPC. Appeal filed by the petitioner against the said judgment/order of conviction and sentence was dismissed by the Appellate Court vide judgment dated 1.8.2012. Hence, the present petition by the petitioner.
(3.) Prosecution story, in brief, is that on 14.9.2007, Deepak Sharma was travelling on a motorcycle from Chandigarh towards his house in Manimajra. A car bearing registration No. CH-03U-7825, over took his motorcycle. At about 5.45 A.M., when Deepak Sharma reached I.T.Park traffic light point, he saw that the car driver, without caring for the red light, had crossed the same and had hit against the motorcycle coming from Manimajra, going towards Sector 26, Chandigarh. The motorcycle had crossed on a green light signal. As a result of this, Neeraj, who was travelling on the motorcycle, suffered injuries. The car driver disclosed his name as Sukhbir Singh. On the basis of the statement of the complainant, formal FIR was registered.
