GURNEK SINGH ALIAS GAGANI Vs. STATE OF PUNJAB

JUDGEMENT

(1.) Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in FIR No. 23 dated 2.3.2012 under Section 307, 323, 341, 148, 149 of the Indian Penal Code ('IPC' for short) registered at Police Station Balachaur, District Shaheed Bhagat Singh Nagar.

(2.) Learned counsel for the petitioner has submitted that the petitioner is in custody for about four months. Petitioner was not attributed injury falling within the ambit of Section 307 IPC. Petitioner was attributed simple injury to injured Pardeep Kumar. Learned State counsel, on the other hand, has opposed the petition.

(3.) After hearing the learned counsel for the petitioner and the learned State counsel, I am of the opinion that the instant petition deserves to be allowed.
