JUDGEMENT

(1.) Defendant Kartar @ Kartar Singh has filed this revision petition under Article 227 of the Constitution of India impugning order dated 19.09.2011 (Annexure P-2) passed by learned Additional Civil Judge (Senior Division), Rewari thereby striking off the defence of the defendant petitioner for non-filing of written statement.

(2.) I have heard learned counsel for the petitioner and perused the case file.

(3.) The defendant-petitioner put in appearance in the trial court through counsel on 29.04.2011, but did not file the written statement till 19.09.2011, and therefore, the trial court passed the impugned order striking off the defence of the defendant-petitioner.
