AJAY SINGH Vs. STATE OF HARYANA

Decided On April 27, 2012
AJAY SINGH Appellant
V/S
STATE OF HARYANA Respondents

JUDGEMENT

(1.) THE prayer made in this petition is for quashing order dated 10.4.2012 (P-19), passed by the Returning Officer Shri Chander Parkash-respondent No. 2, who has been appointed by order of this Court dated 4.10.2011 passed in a bunch of petitions, to hold the election of Jat Education Society (Regd.), Rohtak. THE basic ground for challenging order dated 10.4.2012 (P-19) is that the names of life members numbering about 33,500 have been unfairly excluded from the list of voters. Some objections have also been raised with regard to the exclusion of names of 16,330 life members who are stated to have been enrolled by the Head Master, Jat High School, Rohtak-respondent No. 9.

(2.) WHEN the petition came up for consideration yesterday we have asked Mr. H.S. Hooda, learned Advocate General, Haryana, to assist us in the matter because he has been closely associated with this Society and litigation. Accordingly, we have heard him today in detail.

(3.) IN view of the above, the writ petition is disposed of with liberty to the petitioners to avail any of the aforesaid remedies in accordance with law. However, it is made clear that the Returning Officer-respondent No. 2 shall proceed with the election as per the programme issued. We would also observe that any effort to scuttle election process should be discouraged. Disposed of.
