JUDGEMENT

(1.) The applicant seeks condonation of delay of 117 days in filing the application under Section 378 (4) Cr.P.C, for leave to file an appeal against the judgment of acquittal.

(2.) After hearing the learned counsel for the applicant, we are satisfied that the reasons given in the application are sufficient to condone the delay.

(3.) In view of the above, the instant application is allowed for the reasons stated therein and delay of the 117 days is condoned.
