BALBIR SINGH Vs. STATE OF PUNJAB

JUDGEMENT

(1.) Appellant Balbir Singh has preferred this appeal challenging his conviction and sentence under Section 302 of the Indian Penal Code ('IPC' for short) as ordered by the trail court vide judgment/order dated 16.5.2007.

(2.) Process of law, was set in motion, on the basis of the statement of complainant Sukhjit Singh. The complainant made a statement before Assistant Sub Inspector Bishan Dass on 3.6.2005 at about 3.10 A.M. that he was running an electric shop at Bus Stand Kharora. He was residing from childhood in the house of his maternal grand-parents at village Badochhi Kalan. Kirandeep Kaur, daughter of his maternal uncle Darbara Singh, was married to Balbir Singh about 16 years back. She had been blessed with two children i.e. a girl and a boy. Kirandeep Kaur and her husband had been quarreling with each other for the last 3/4 years. On 3/4 occasions, the matter had been got compromised in a Panchayat. Kirandeep Kaur had been harassed by her sister-in-law Balbir Kaur alias Guddi, brotherin-law Randhir Singh, Jasbir Kaur (sister-in-law of Balbir Singh) and her husband Balbir Singh. On 3.6.2005 at about 10.30 A.M., his maternal uncle Tehal Singh told him that Kirandeep Kaur was admitted in the hospital as she had suffered an electric shock. When he reached village Kalewal along with others, he found that his sister Kirandeep Kaur had died. When he entered the room where his sister was lying on a cot, he found that there were marks of injuries on her person. Kirandeep Kaur had been killed by his brother-in-law Balbir Singh in connivance with Randhir Singh, Balbir Kaur and Jasbir Kaur by giving her electric shock and beatings. Balbir Kaur used to stop Kirandeep Kaur from meeting her relatives.

(3.) On the basis of the statement of the complainant, formal FIR No. 46 dated 3.6.2005 was registered at Police Station Kurali under Section 302, 120-B IPC.
