The crux of the facts & material, culminating in the commencement, relevant for the limited purpose of deciding the core controversy, involved in the instant appeal and emanating from the record, is that, appellant Surinder Kumar was charge sheeted for the contravention of provisions of Rule 51 of the Regulations of supply & Distribution Order 1993 (for brevity "the relevant Rules") regarding the LPG, punishable under section 7 of the Essential Commodities Act, 1955 (hereinafter to be referred as "the EC Act") by the Special Judge.

Having completed all the codal formalities, the trial Court convicted & sentenced the appellant to undergo rigorous imprisonment for a period of two years, to pay a fine of Rs. 2000/- and in default of payment of fine, he was further ordered to undergo rigorous imprisonment for a period of three months under Section 7 of the EC Act, by way of impugned judgment of conviction & order of sentence dated 15.12.2000.
(3.) The appellant did not feel satisfied and preferred the present appeal to set aside the impugned judgment of conviction & order of sentence of the trial Court. That is how I am seized of the matter.
