JUDGEMENT

(1.) Gurpinder Singh and Sukhdev Singh, the petitioners have sought pre-arrest bail in a case registered by way of FIR No.96 dated 14.04.2012 at Police Station Cantonment, Amritsar, for an offence punishable under sections 420, 467, 468, 471 and 120-B IPC.

(2.) Learned counsel for the petitioners has submitted that this is a case of a dispute between landlord and tenant. According to him, the petitioners are tenants in possession of shop No.71 situated at Kabir Park/Kabir Market, opposite Guru Nanak Dev University, G.T.Road, Amritsar under the complainant w.e.f. 01.10.2010 on payment of Rs.3000/- per month as rent. He has further submitted that the petitioners filed a suit for permanent injunction restraining the complainant i.e. Smt. Baljinder Kanwaljit Kaur from forcibly dispossessing them from the said shop.

(3.) According to him, when notice of the suit reached the complainant, she has lodged this FIR. According to him, Sukhdev Singh, petitioner no.2 has obtained electricity connection for this premises and the petitioners are in established possession over the property as tenants and that the complaint is false.
