JUDGEMENT

(1.) Defendant No.2-Jai Narain having lost in both the Courts below has filed this second appeal.

(2.) Respondent No.1-plaintiff filed suit against Khazana-defendant No.1/proforma respondent No.2 and Jai Narain defendant No.2/appellant for possession of the suit land measuring 1 kanal comprised in khasra No.1149 alleging that he is cosharer in the suit land and defendants were permitted by the plaintiff and other cosharers to collect dung cakes, manure etc. in the suit land, but now the defendants on demand have refused to vacate the suit land. Accordingly the plaintiff filed suit for possession of the suit land.

(3.) Defendant No.1 claimed adverse possession over the suit land for more than 12 years.
