JUDGEMENT

(1.) CM No.6542-C of 2012 Allowed as prayed for. CM No.6543-C of 2012 For reasons mentioned in the application, which is accompanied by affidavit, delay of 92 days in re-filing the appeal is condoned. RSA NO.2315 OF 2012

(2.) DEFENDANT Surjit Kaur having lost in both the courts below has filed this second appeal.

(3.) THE plaintiffs alleged that the suit land was allotted to them by consolidation department vide order dated 11.01.1985. THE plaintiffs along with other cosharers claimed to be owners in possession of the suit land since the year 1985. THE defendants without any right, title or interest in the suit land threatened to take forcible possession thereof. Plaintiffs claimed permanent injunction against the defendants, restraining them from doing so.
