JUDGEMENT

(1.) The challenge by way of this revision petition is to the order dated 03.05.2010 (Annexure P-4) passed by learned Additional Chief Judicial Magistrate, Bathinda, vide which application of the prosecution under section 319 Cr.P.C. has been allowed and the petitioner has been summoned to stand trial and the judgment dated 14.10.2011(Annexure P-5) passed by learned Sessions Judge, Bathinda, vide which revision petition filed by Sukhpal Singh against the said order has been dismissed.

(2.) The case had been registered against Harpreet Singh and others by way of FIR No. 403 dated 09.09.2000 at Police Station Kotwali, Bathinda, for an offence punishable under sections 148, 307,336, 447, 452, 506 and 323 read with section 149 IPC and section 25 of the Arms Act.

(3.) After due investigation, Harpreet Singh and others had been sent to stand trial. At the trial after examination of the complainant Pardish Kumar as PW-2, application under section 319 Cr.P.C. was made for summoning Surinder Pal, Jatinder Kumar, Devinder Singh and Sukhpal Singh as accused, which was allowed vide order dated 03.05.2010 summoning all the four persons. Out of them , Sukhpal Singh, the petitioner went in revision against the said order and learned Sessions Judge, Bathinda, vide judgment dated 14.10.2011 dismissed his revision petition.
