JUDGEMENT

(1.) Applicant-Paramjit Kaur is the wife of deceased Jaswinder Singh alias Jassa Singh. She has filed this application under Section 378(4) Cr.P.C. seeking leave to file an appeal against the judgment dated 21.10.2011 vide which respondents No.2 to 5 were acquitted of the charges framed against them. It was an allegation against the above respondents that they along with eight other accused had committed murder of Jaswinder Singh alias Jassa on 19.10.2008 by giving him injuries with sharp edged weapon.

(2.) The process of law was started on a statement made by Mukhtiar Singh (PW.1). The trial Judge has noted the following facts regarding case of the prosecution as contained in the statement made by the above witness:-

(3.) When a large number of people gathered at the spot, the assailants fled away from the spot along with their weapons. The injured was taken to the Civil Hospital, Samana and thereafter he was referred to Rajindra Hospital, Patiala and then to PGI at Chandigarh, where he died on 22.10.2008.
