(1.) The present C.M. Application No. 13488 of 2002 has been filed by the petitioners. It has been prayed in the application that the respondents be restrained from filling up Group-D, Class IV Posts of Panchkula Distt. from other sources than the petitioners during the pendency of the writ petition. In fact, while hearing the arguments upon the aforesaid application, I found that the said application could not be adjudicated properly without adverting to the main controversy involved in the writ petition. Therefore, with the consent of the parties, the main writ petition No. 10610 of 1999 has been taken on board. CWP No. 10610 of 1999
(2.) This order shall dispose of the main writ petition No. 10610 of 1999.

The petitioners have filed the present writ petition on the ground that they are working on daily wage basis in the Police Department for the last more than six years (since 1995-on different dates) as Class IV employees. The prayer made in the writ petition is for regularisation of their services. The petitioners had earlier also filed a writ petition in this Court and the said writ petition was disposed of vide orders dated August 18, 1997, whereby Division Bench had directed that respondent No. 2 would decide the representation filed by the petitioners by a speaking order. Thereafter, vide orders annexure P-7 dated December 2, 1997, the Deputy Inspector General of Police, Ambala Range, Ambala Cantt. held that the claim of the petitioners except Kamal and Balwan is rejected, as they do not fulfil the conditions for regularisation under the policy of Haryana Government. However, the cases of these two employees namely Kamal and Balwan, who fulfilled the conditions and found eligible for regularisation, were sent separately to the Government for regularisation.
