JUDGEMENT

(1.) We have heard the learned counsel for the petitioner at some length.

(2.) The challenge in the writ petition filed under Article 226/227 of the Constitution of India is to the award dated the June 13, 2001 (Annexure P-7) passed by the Presiding Officer, Labour Court, Ambala, vide which the reference of the workman was decided against him.

(3.) The finding recorded is that the petitioner was employed on contractual basis for three months' period vide appointment letters, Exhibits M-1 to M-4. Admittedly, these appointments had breaks; they were not continuous and any oral evidence led contrary to written document can hardly carry any weight. These are the findings of facts as recorded on proper appreciation of evidence. Provisions of Sections 2(oo)(bb) of the Industrial Disputes Act, 1947 were not attracted in the facts and circumstances of the present case.
