JUDGEMENT

(1.) Petitioner, Devinder Kumar Gupta, seeks anticipatory bail in case bearing F.I.R. No. 116 dated 1 5.5.2001 registered under section 420, 406, 504, 506, I.P.C. with Police Station Bilaspur.

(2.) The present case was registered on the statement of Narinder Nagpal resident of Krishna colony, Gurgaon. Complainant had stated that his daughter Aarti Nagpal had taken admission in Instrumentation and control Engineering for the session 2000-2001 in Anupam Engineering College. Due to malfunctioning of the college and the role played by R.K. Gupta founder of College the High Court and the M.D. University, Rohtak cancelled its affiliation. Thereafter, the boys and girls who had been admitted in college were shifted to other colleges. Accordingly, Aarti Nagpal was also shifted along with other students. Her documents and certificates were retained by the college Authorities. When the complainant visited the college to collect those documents he was harassed and made to visit time and again. He was even threatened with death. It is further alleged that the college authorities had charged Rs. 2,000/- per student despite the fact that the value of the books was much low. The college thereafter remained closed. When the other boys and girls demanded back their certificates the college authorities refused to return the same. This led to registration of the present case.

(3.) During the investigation of the case, petitioner-accused handed over all the original documents relating to Aarti Nagpal to the S.H.O. of the Police Station on 4.2.2001. It was further revealed in investigation that a sum of Rs. 2,500/- each was taken as security by the Institute from the students namely, Narender and Nepal Singh which amount has not been returned to them. The other students, namely, Laxman Mehlawat, Chakshu Sharma, Shiksha Sharma and Archana Ahuja also complained that their original documents have not been returned to them.
