SUKHDEV KAUR Vs. STATE OF PUNJAB

JUDGEMENT

(1.) This is a petition under Section 482 Cr.P.C for issuance of appropriate directions to Respondents No. 1 to 3 to properly investigate FIR No. 4 dated 08.01.2010 registered at Police Station Bilga District Jalandhar under Section 447, 379, 506, 148, 149 IPC and to arrest Respondents No. 4 to 7.

(2.) Reply by way of affidavit of Jasbir Singh, PPS, DSP, Phillaur, District Jalandhar has been filed. As per the reply, Bahadur Singh son of Bhajan Singh-Respondent No. 4 moved an application for reinvestigation of the aforesaid case with DSP, Phillaur vide No. 177-R/DSP/PHR dated 26.02.2010 and the matter was thoroughly investigated by the then DSP, Phillaur and found that the house in dispute was purchased by Respondent No. 4 namely Bahadur Singh son of Bhajan Singh resident of Village Rawan, Tehsil Phillaur, District Jalandhar from one Smt. Gurdev Kaur wife of Sarwan Singh resident of Village Rawan for a sum of Rs. 1,30,000/- about eight years back and electricity meter is installed in the name of his father and the same is in possession of Respondent No. 4 and the Petitioner has no other documents except one suspicious Will which may show her ownership over the house in dispute and the Petitioner has lodged false case bearing No. 04 dated 08.021.2010 under Sections 447, 379, 506, 148, 149 IPC at the instance of some anti social elements, during the investigations, it came to light that Respondent No. 4 namely Bahadur Singh is residing in the house in dispute for the last 8-9 years and the said house is in possession of Bahadur Singh and accordingly, the said DSP found that the incident as mentioned in the FIR has never taken place. Respondent No. 3 has submitted the cancellation report for approval.

(3.) On instructions from ASI Sarabjit Singh, it is pointed out by learned State counsel that the said cancellation report is pending before the SSP (Rural) Jalandhar, for approval.
