(1.) Petitioner Mangal Singh retired from Punjab Govt. service on 31.12.1986 as Block Development and Panchayat Officer (for short B.D.P.O.). The pay scale of the post of B.D.P.O. was Rs. 1200-1700 and the petitioner was drawing Rs. 1700/- per month as his basic pay at the time of his retirement. A certificate issued by the B.D.P.O. dated 22.1.87 has been attached to the above mentioned effect.
(2.) Petitioner applied to the District Manager (Telephones), Amritsar on 4.5.1987 for a telephone connection under Non-OYT-SS category for retired Central/State Govt. officers.

The Department of Telecommunication, Sanchar Bhawan, New Delhi issued instructions through a circular dated 26.11.1987 (Annexure P-2 to the writ petition) in which it has been mentioned that certain cases of State Govt. Officers had come to the notice of the office where the concerned State Governments had not yet revised the pay scales of their officers in accordance with the recommendations of the Fourth Pay Commission and those officers continued to draw their pay in the old scales. Since on 10.7.1987 minimum pay requirements were prescribed for being entitled to be considered under the Non-OYT-SS Category for the retired Central/State Government Officers, it has been decided that wherever a State Government had not revised the pay scale of its officers on the lines of the recommendations of the Fourth Pay Commission, the minimum pay required for the State Government Officers for being eligible for Non-OYT-SS Category would continue to be Rs. 1600/- per month (basic pay and special pay) as prescribed under department letter dated 19.3.81 till the pay scales were revised by the concerned State Governments.
