(1.) This judgment will dispose of C.W.P. Nos. 399 and 6503 of 1987, filed by the same petitioner.

Briefly the facts of the case are that the petitioner was initially appointed as a Conductor by the respondent-Director, State Transport, Punjab, on 6th June, 1962, and he worked as such in leave vacancies continuously till 22nd February, 1964, when his services were regularised through the Subordinate Services Selection Board. Mool Chand and Rattan Singh, Respondent Nos. 3 and 4 in C.W.P. No. 339 of 1987 were directly recruited as Conductors on 27th June, 1962 and 28th June, 1962, respectively. A seniority list of the Conductors was circulated on 17th August, 1981, depicting the seniority position of the Adda Conductors of the Punjab Roadways who had been appointed between the period 1.1.1962 to 31.12.1975. The petitioner was shown at Serial No. 29 in the said seniority list; whereas Respondents Nos. 3 and 4 were shown at Serial Nos. 33 and 34, respectively.

With effect from 2nd June, 1977, statutory Rules known as Punjab Roadways Operational (State Service) Class III, Rules 1977 (hereinafter referred to as the Rules) were enforced, which governed the service conditions of the Conductors. Rule II of the Rules, which deals with the seniority of the members of the service, is in the following terms :-
