JUDGEMENT

(1.) NARINDER Singh son of Sadhu Singh has moved this Court under section 482 of the Code of Criminal Procedure and prayed that FIR No. 82 registered long ago on 11.9.1990 at Police Station Mohali under sections 420, 468 and 471 of the Indian Penal Code be quashed against him as well. Briefly, the facts are that in September 1980 it came to the notice of the Secretary, Punjab School Education Board, S.A.S. Nagar, Mohali that Ranjit Singh son of Mohinder Singh got printed forged matriculation certificates purported to have been issued by the aforesaid Education Board and sold them for consideration to various persons. During the investigation it came to notice that Narinder Singh was also an associate of the aforesaid accused in the sale of aforesaid certificates. The case remained pending investigation for a long time. However, now after a lapse of about ten years a challan has been presented against the present petitioner.

(2.) ON behalf of the petitioner it has been argued that there might have been some other employee working as a clerk in the Punjab School Education Board who probably forged the certificates and indulged in their sale and that no offence whatsoever has been made out against the petitioner and that this FIR has been quashed as against another accused in Criminal Misc. No. 466-M of 1986 Jaswinder Singh v. State of Punjab by Surinder Singh, J. on 17-2-1986. No reply has been filed to this petition on behalf of the respondent despite several opportunities.

(3.) THIS also disposes of Criminal Misc. No. 13326-M of 1490 and the petition of Balwinder Kaur alias Bhupinder Kaur is also accepted and the aforesaid FIR is quashed qua her as well. Order accordingly.
